Der Commercial Court – Senat für Bau- und Architektensachen ist gemäß § 1 Abs. 2 Nr. 1 a) der Commercial-Court- und Commercial-Chambers-Verordnung nach Parteivereinbarung erstinstanzlich zuständig für Streitigkeiten mit einem Streitwert ab 500.000 Euro zwischen Unternehmern im Sinne des § 14 des Bürgerlichen Gesetzbuchs aus Bau- und Architektenverträgen sowie aus Ingenieurverträgen, soweit sie im Zusammenhang mit Bauleistungen stehen.

The Commercial Court senate for construction and architect matters has jurisdiction in the first instance on the basis of an agreement between the parties on the choice of forum. Pursuant to Section 1 (2) No. 1 a) of the Ordinance on the Commercial Court and Commercial Chambers it is responsible for disputes with a value in dispute of EUR 500,000 or more between entrepreneurs within the meaning of Section 14 of the German Civil Code (Bürgerliches Gesetzbuch) arising from construction and architect's contracts as well as engineering contracts, insofar as they relate to construction services.
